This Agreement is entered into between the Guest and Trophy Properties Caribbean Ltd. (the "Booking Agent"), who is acting as an agent for the Guest's rental of this property (hereafter the “Villa") with the Villa Owner and/or its Property Manager (collectively, the "Villa Providers"). For the purposes of this Agreement, the term "Protected Entities" refers collectively to the Booking Agent, the Villa Owner and Property Manager (if applicable), as well as their respective principals, directors, shareholders, parent companies, employees, onsite staff, management teams, agents, contractors, sub-contractors, vendors, service providers, maintenance crews, affiliates, advertisers, marketing partners, and business associates.
BINDING CONDITIONS FOR BOOKING CONFIRMATION:
The Guest acknowledges and agrees that a reservation is tentative only and reservation details and cost (including, but not limited to check in and check out dates, nightly rental rate, service charge and government taxes) are not confirmed until the Guest has completed any required, property-specific rental agreement (hereafter “The Villa Providers’ Agreement”) including any maximum occupancy requirement, house rules and guest code of conduct policies provided by the Booking Agent and Villa Providers and Guest has paid the required deposit/payment and payment has been confirmed as received and cleared by the Booking Agent and Villa Providers. Failure to satisfy these conditions within the specified timeframe may result in the release of the dates and the cancellation of the pending reservationPAYMENT METHODS AND TRANSACTION FEES:
Guest may pay by credit card (cards accepted may vary by Villa). All payments made via credit card (including but not limited to deposits, balances, taxes, service charge, administrative fees and optional services and incidentals arranged on your behalf) are subject to a non-refundable 4% transaction fee. Payment by ACH/Wire Transfer is also offered and guests are responsible for all bank fees.TRAVEL INSURANCE:
It is the sole responsibility of the Guest to purchase a comprehensive Travel Insurance policy, as the Booking Agent and Villa Providers are not responsible for costs associated with travel delays, cancellations for any reason, or medical emergencies.VILLA DEPOSIT & CANCELLATION POLICIES
Payments can be made by wire transfer or credit card (non-refundable credit card transaction fees apply). A deposit payment of 50% of total booking (including tax, service and any credit card transaction fees) is due at time of booking. The full balance is due/paid 60 days prior to arrival. If booking is made less than 60 days prior to arrival, 100% of booking amount (including tax, service and any credit card transaction fees) is due at time of booking.
Full refund (including tax and service and excluding any non-refundable credit card transaction fees) less 10% administrative fee if cancel at least 120 days prior to date of arrival. For cancellations received less than 120 days prior to date of arrival where owner is able to re-rent Villa to another vacation for entire period of Guest’s cancelled stay, owner will refund monies paid (including tax and service and excluding non-refundable credit card transaction fees) less a 30% administrative fee. Otherwise no refunds.PET POLICY AND COMPLIANCE:
Pets are prohibited unless specifically approved in writing by the Booking Agent and Villa Providers in advance and may require Guest to agree to additional fees and terms. Guests are responsible for securing mandatory Anguilla government permits for approved pet entry into Anguilla.PROPERTY REPRESENTATION:
All photographs and descriptions of the villa’s interior and exterior (including but not limited to furniture, décor, equipment, staff and landscaping), surrounding area (including beach quality and water conditions) are provided in good faith. These elements are subject to environmental and natural conditions, change, repair, or replacement at any time, and the Booking Agent and Villa Providers do not guarantee that the property and surrounding area’s exact contents or appearance will remain identical to the promotional materials at the time of Guest occupancy.OPTIONAL SERVICES:
The Booking Agent and Villa Providers may facilitate Optional Services provided by independent third-party vendors (including but not limited to private chefs, childcare, massage, excursions, transfers, and car rentals). The Guest is responsible for all vendor costs (e.g. goods and services) plus any applicable administrative fees (typically 15% of cost of goods and services) and credit card processing fees charged by the Booking Agent or the Villa Providers. The Protected Entities do not and cannot guarantee, warranty, or certify the quality of goods and services given by third parties, notwithstanding that they will make every effort to give satisfactory recommendations.RELEASE OF CLAIMS AND HOLD HARMLESS:
The Guest, on behalf of themselves and all guests occupying the Villa, hereby indemnifies and holds harmless the Protected Entities (the "Released Parties") from any and all claims, damages, or liabilities. Guests fully and forever waive their right to sue the Released Parties for any claims—including bodily injury, illness, death, or property damage—arising from the acts of Guests, services provided by third-party vendors (including but not limited to excursions, massages, and boat/air travel), or any matters not resulting from the Released Parties' gross negligence or willful misconduct.FORCE MAJEURE:
The Protected Entities are not responsible for events or inconveniences beyond their control. This includes, but is not limited to: hurricanes, tropical storms, flooding, pandemics, government border closures, off-property construction, illness, injury, death, labor shortages, labor strikes, war, government health protocols, government policies, power outages, adverse weather conditions, mandatory evacuation, or mechanical failure. In the event of a mandatory evacuation or a named storm warning for Anguilla, the Protected Entities are not liable for any costs or losses incurred by the Guest. It is the responsibility of the Guest to obtain travel insurance that covers these types of events.GOVERNING LAW & JURISDICTION:
This Agreement is governed by the laws of Anguilla, and any legal proceedings must be filed exclusively in the courts of Anguilla.ACKNOWLEDGMENT:
By providing electronic acceptance and/or payment for this reservation, the Guest confirms they have read, understood, and agreed to this document, including the credit card transaction and administrative fees, the release of claims, the recommendation to obtain travel insurance, and the requirement to execute an additional and separate Villa Providers’ Agreement. The Guest and The Booking Agent agree that the terms of this agreement may not be modified except in writing signed by both parties. In the event of any conflict between any provision of the above terms and the Villa Providers’ Agreement, the relevant provision of the Villa Providers’ Agreement shall take precedence.
